THE STATUS O *" - * GRAND AND PROVINCIAL GRAND OFFICERS . To the Editor of the "Freemason . " Dear Sir and Brother , —¦ The recent correspondence between the Grand Registrar and Bro . Newmarch , late D . P . G . M . for Gloucestershire , suggests several considerations .

A . No doubt Bro . Newmarch is right in his abstract proposition—that the question must be decided by thc Book of Constitutions alone , and not by usage or precedent . Thc matter is not a subject of favour or concession ; it is one purely of law and right . 13 . But what does the Book of Constitutions say ? As

Bro . Newmarch states , it undoubtedly in its verbiage , which is open to doubt , declares that Provincial Grand Officers are "invested in the Provincial Grand Lodge , " and " shall possess within their district the rank and privilege of Grand Oflicers . " Undoubtedly this is so , and these words constitute the " crux . " If Bro . Newmarch ' s contention bc

correct , thc ' precedence " of the Grand Lodge is to be observed in thc Provincial Grand Lodge ; and as Grand Wardens takes precedence of all other " officers , " so Provincial Grand Maidens take precedence of all other officers , whether Grand or Provincial , in their own province , if senior to them in date of appointment . If there

be Grand Wardens and Provincial Grand Wardens present , then comes in the date of appointment , which constitutes seniority—at , least , I presume Bro . Newmarch concedes this ,- -so that all Grand Officers who arc inferior to Grand Wardens in Grand Lodge come behind Provincial Grand Wardens in Provincial Grand Lodge . If this be so ,

then , I confess , I do not see how the Grand Registrar ' s " rcditetio ad absuvdum " can be avoided , that the Provincial Grand Master , being a . Grand Master in his province , takes precedence of the Grand Master himself , unless the appointment of the latter is earlier than that of the former . Bro . Xeivmnich sees the difficulty , and seeks to convey the

idea , that thc Grand Master being the "fountain of honour , " Sic ., is practically excluded from the operation of these laws , and here , too , Bro . Newmarch is inconsistent with himself , in that he " claims" the law , thc whole law , and nothing but the law . Such a view , however right " per se , " is alien to thc Book of Constitutions .

C . But must not Bro . Newmarch go a step further ? It is an old axiom of the law , that though the "grantor" may convey certain actual or stipulated rights to thc " grantee , " thc original right ( jus ) remains in thc "grantor . " The Grand Master gives a delegated right to the Provincial Grand Master , who is a representative of thc Grand Master , and

he , in his turn , grants certain rights and rank to his Provincial Grand Officers , which are declared by the Book of Constitutions to bc in the province of equal value and rank with those of thc Grand Lodge itself . But this concession by no means deprives the holders of rank emanating directly from the G . M . ( the original

grantor ) of their claim to superiority , which is in no way affected by the grant of a subsidiary of tantamount rank fo the Provincial Officers in the provinces . And , therefore , 1 , for one , hold , with all respect to Bro . Newmarch and our many excellent provincial brethren , that the Grand Registrar is right when he says that the " Grand Officers

of England are Grand Oflicers of England and every province thereof , and in each province take precedence of the Provincial Grand Officers , in like manner as the M . W . Grand Master , by whom they are appointed , takes prcce . cencc in every province of the Prov . Grand Master , by whom the Prov , Grand Oflicers arc appointed . "

There is a great difference between the functions of a Prov . Grand Master and a D . Prov . Grand Master as laid down by the Book of Constitutions , which certainly weak-ens Bro . Newmarch ' s argument as regards the co-equal rights of Grand ami Prov . Grand Officers . The Deputy Grand Master has thc same right ,

practically , as the G . M ., in that be can preside in any lotlge with the Master of the lodge on his right , and the Grand Wardens are to act as Wardens . In the case of the D . P . G . M ., he can ' * ' preside in a lodge , " but that is all . I do not know lhat you can press the argument mile !)

either way , but it appears to me that this essential diffcrrnre of duties is fatal lo the contention that the D . Prov . G . M ., who is D . G . M . in his own province , would take precedence of a D . G . M . if his patent was earlier . Perh . ip-j Bro . Neii-marc ' i does not mean so to contend . but if his argument be valid , such must be the necessary cnn ^ ei - iuence- indeed of his own position , "h fortiori . "

THE STATUS O *" - * GRAND AND PROVINCIAL GRAND OFFICERS . To the Editor of the "Freemason . " Dear Sir and Brother , —¦ The recent correspondence between the Grand Registrar and Bro . Newmarch , late D . P . G . M . for Gloucestershire , suggests several considerations .

A . No doubt Bro . Newmarch is right in his abstract proposition—that the question must be decided by thc Book of Constitutions alone , and not by usage or precedent . Thc matter is not a subject of favour or concession ; it is one purely of law and right . 13 . But what does the Book of Constitutions say ? As

Bro . Newmarch states , it undoubtedly in its verbiage , which is open to doubt , declares that Provincial Grand Officers are "invested in the Provincial Grand Lodge , " and " shall possess within their district the rank and privilege of Grand Oflicers . " Undoubtedly this is so , and these words constitute the " crux . " If Bro . Newmarch ' s contention bc

correct , thc ' precedence " of the Grand Lodge is to be observed in thc Provincial Grand Lodge ; and as Grand Wardens takes precedence of all other " officers , " so Provincial Grand Maidens take precedence of all other officers , whether Grand or Provincial , in their own province , if senior to them in date of appointment . If there

be Grand Wardens and Provincial Grand Wardens present , then comes in the date of appointment , which constitutes seniority—at , least , I presume Bro . Newmarch concedes this ,- -so that all Grand Officers who arc inferior to Grand Wardens in Grand Lodge come behind Provincial Grand Wardens in Provincial Grand Lodge . If this be so ,

then , I confess , I do not see how the Grand Registrar ' s " rcditetio ad absuvdum " can be avoided , that the Provincial Grand Master , being a . Grand Master in his province , takes precedence of the Grand Master himself , unless the appointment of the latter is earlier than that of the former . Bro . Xeivmnich sees the difficulty , and seeks to convey the

idea , that thc Grand Master being the "fountain of honour , " Sic ., is practically excluded from the operation of these laws , and here , too , Bro . Newmarch is inconsistent with himself , in that he " claims" the law , thc whole law , and nothing but the law . Such a view , however right " per se , " is alien to thc Book of Constitutions .

C . But must not Bro . Newmarch go a step further ? It is an old axiom of the law , that though the "grantor" may convey certain actual or stipulated rights to thc " grantee , " thc original right ( jus ) remains in thc "grantor . " The Grand Master gives a delegated right to the Provincial Grand Master , who is a representative of thc Grand Master , and

he , in his turn , grants certain rights and rank to his Provincial Grand Officers , which are declared by the Book of Constitutions to bc in the province of equal value and rank with those of thc Grand Lodge itself . But this concession by no means deprives the holders of rank emanating directly from the G . M . ( the original

grantor ) of their claim to superiority , which is in no way affected by the grant of a subsidiary of tantamount rank fo the Provincial Officers in the provinces . And , therefore , 1 , for one , hold , with all respect to Bro . Newmarch and our many excellent provincial brethren , that the Grand Registrar is right when he says that the " Grand Officers

of England are Grand Oflicers of England and every province thereof , and in each province take precedence of the Provincial Grand Officers , in like manner as the M . W . Grand Master , by whom they are appointed , takes prcce . cencc in every province of the Prov . Grand Master , by whom the Prov , Grand Oflicers arc appointed . "

There is a great difference between the functions of a Prov . Grand Master and a D . Prov . Grand Master as laid down by the Book of Constitutions , which certainly weak-ens Bro . Newmarch ' s argument as regards the co-equal rights of Grand ami Prov . Grand Officers . The Deputy Grand Master has thc same right ,

practically , as the G . M ., in that be can preside in any lotlge with the Master of the lodge on his right , and the Grand Wardens are to act as Wardens . In the case of the D . P . G . M ., he can ' * ' preside in a lodge , " but that is all . I do not know lhat you can press the argument mile !)

either way , but it appears to me that this essential diffcrrnre of duties is fatal lo the contention that the D . Prov . G . M ., who is D . G . M . in his own province , would take precedence of a D . G . M . if his patent was earlier . Perh . ip-j Bro . Neii-marc ' i does not mean so to contend . but if his argument be valid , such must be the necessary cnn ^ ei - iuence- indeed of his own position , "h fortiori . "
